This Agreement is between the Delta Farmers Market / the Delta Farmers Market Bazaar (DFM) (DFMB), located at 1001 Hwy 92, Delta CO 81416 (TRUVU DriveIn), and ____________________________________________________________________________________________________
(the Vendor) to sell products compliant with not only this Market’s standards, but also the laws of
the state of Colorado as well as the laws of the United States.
This contract shall begin on ______ (date) and shall last until the end of the 2025 Market season, save and except the provisions related to indemnification, limitations of liability, governing law, and forum which shall survive termination. In consideration for the terms described in this Agreement, Vendor agrees to pay the vendor fees and adhere to the provisions of this Agreement and the Market agrees to provide the Vendor with an area to sell Vendor’s products and adhere to the provisions of this Agreement. This agreement is nonassignable. This agreement may be amended or modified in writing executed by both parties.
Market Manager/Admin: The Market Manager/Admin is understood to mean the person designated by the Market to supervise operations of the Market. The Market Manager/Admin has/have the discretion and authority to interpret this Agreement and decide if a Vendor is in breach. Vendor Fees to Join the Market: Vendor must pay a seasonal fee of either $80.00/Market or $100.00/Bazaar to sell during the 2025 Market season to be paid by the first day of Vendor participation, unless other arrangements have been made. Conversely, a daily fee of $30/day is to be collected for those vendors who prefer to pay daily. Fees allow for one 10'x10' space.
The DFM is a producer-only Market. All products must be grown, raised, or produced by the business selling the products.
DFM APPROVED PRODUCTS include any of the following: fresh and unpackaged home-grown vegetables, fruit, nuts, and cut flowers; potted plants and herbs (annuals and perennials); dried flowers; and fresh, home-grown food products that are minimally processed and packaged in new containers by the Vendor such as honey, other syrups, jellies, jams, preserves, persimmon pulp, dried spices and herbs, flour, cornmeal, unpopped popcorn, seeds, canned produce, cider and other pressed juices, dairy products, and vinegars. (Colorado Cottage Law requirements and exclusions met) Only products that have been organically grown by a Vendor who is a certified organic farmer may be labeled as organic.
NOT ALLOWED: No prepared foods (except bakery items), no prepared beverages.
The DFM Bazaar is a market provided for the selling of high quality new and used household, personal, collectible and antique items.
Selling or trading of live animals is expressly forbidden at both Markets.
Additionally, all products sold at the DFM/DFMB must be, in the opinion of the Market Manager/Admin, of high quality and free of pests, disease, rot, and spoilage. The Market Manager has the authority to deny a Vendor the right to sell products that are of inferior quality.
Compliance with Laws and Permitting Requirements: The Vendor is required to comply with all applicable local, state, and federal laws and/or permitting requirements at all times.
In order to sell at the Market or Market Bazaar, Vendors must obtain a Delta City Sales Tax License. All other licensing, compliance, insurance, etc. is the sole responsibility of the vendor.
Your city sales tax license number must be remitted to the Market Manager/Admin along with this Agreement.
Hours of Operation: The Delta Farmers Market (DFM) will operate on Saturdays from 9AM-2 PM beginning May 3rd, 2025 ending October 25th, 2025. The DFM will also operate on Wednesdays from 9AM-2PM beginning June 4th until August 27th.
The Delta Farmers Market Bazaar (DFMB) will operate Saturdays and Wednesdays 9-2, also Sundays 10AM- 2PM through the end of the 2025 Season(TBD).
Vendor is required to be setup at their stall and be available to customers at least 15 minutes before Market/Bazaar opening.

NO LATE ARRIVALS or EARLY DEPARTURES WILL BE ALLOWED, unless specifically requested and approved.
All attempts should be made to keep our Market consistent, and that includes the reliability of vendors' participation.
All automobiles are to be parked in the designated parking stalls after unloading.
Blocking entry to the Market or preventing access to the Market is expressly forbidden.
Cutoff time for Vendor entry is 30 minutes before Market opening.
Vendors can continue to sell after the Market closes so long as Vendor begins cleaning up at closing time and is out of the Market area in a reasonable amount of time.
Vendor is expected to commit to the DFM or DFM Bazaar to be present for the majority of days for the Season. If it is determined by the Market Manager/Admins that the Vendor has not been attending in a consistent manner the right to sell at the Market and this contract may be terminated.
If requested by the Manager/Admin the Vendor may be responsible for contacting the Market Manager/Admin in advance if they will be absent.
Stalls will be assigned first-come, first-serve on a daily basis when necessary with preference given to those vendors who attend Market days regularly.
Vendor is required to bring their own equipment to the Market. All vendors must have tables/racks to display their items (nothing laying on the ground or in scattered disarray). Vendors should attempt to have a canopy to provide a consistent and appealing aesthetic to the Market and to act as protection and shade from weather and Sun. The Market requires Vendor to have weights on all of their equipment of no less than 40 pounds total. No equipment will be provided by the Market. Vendor is solely responsible for any injury to persons or property caused by Vendor’s equipment. Vendors are allowed and encouraged to have their own appropriate signage and décor as it pertains to their stall area.
Market Safety and Sanitation: Vendors must maintain a clean and sanitary stall. Vendor is responsible for cleaning up their own stalls at the close of the Market. Vendor must take home all of their equipment and must pick up any trash that accumulated at or around their stall throughout the day—including perishable items.
All Vendors must dress appropriately.. Vendors are expected to be cordial and amenable when talking to customers, other vendors and Market Admins. Any coercion, threat of violence (written, verbal or physical), undue sexual attention or attempts at intimidation will be reason to expel Vendor from the Market and deny Vendor the ability to participate at the Market in the future. The Market Manager/Admins have final authority regarding any improper or questionable behavior or information concerning all areas of the Market, including (but not limited to) information which may be made available on any social media websites or other outlets.
Vendors are not allowed to harass or attempt to lure customers away from other vendors.
No distributing of political or religious materials. No handbills, no vulgar or obscene materials within view of the public. No loud or disruptive music or speech.
Vendors may not bring pets or any live animals to the Market with the exception of service animals.
Vendors must supervise their children at all times, and may not allow any children under 12 years old to wander the Market area without a parent or guardian.
Liability Insurance: Vendor is encouraged to maintain an insurance policy covering both general liability and product liability with a minimum of $1,000,000 in coverage. The Market does not provide any insurance coverage for Vendor.
Photography Release: Vendor agrees to allowing photos of themselves, their products and their business, logos & website to be displayed or submitted for public view for the intention of driving customer traffic to the Market. This DOES NOT include photos of minors or other disinterested parties. The Market would also like to include your website, product reviews or other marketing employed to garner customers.
Indemnification, Hold Harmless and Defend: Vendor shall indemnify, hold harmless and defend the Market, its officers, agents and employees from and against any and all demands, claims, suits, damages, losses, liabilities, costs and expenses, including, but not limited to, court costs and attorneys’ fees, of any nature whatsoever (including, but not limited to, property damage and loss, bodily injuries, sickness, disease or death), directly or indirectly arising out of or in connection with Vendor’s participation in the Market. This provision shall survive the termination of this Agreement.
Breach of Contract and Termination: If Vendor violates any of the provisions of this Agreement, he or she will be considered to be in breach. The Market Manager shall have the authority to immediately suspend a Vendor’s right to sell at the market if a breach of this Agreement presents a health or safety risk or is, in the opinion of the Market Manager, a serious breach of this agreement. If requested, a board of Admins is available to weigh and judge any grievances. No refunds will be granted under any condition(s).
Acknowledgment: This agreement sets forth and constitutes the entire agreement and understanding of the parties with respect to the subject matter described above. I certify that I have read and understand the above terms and conditions and that I meet the Vendor criteria stated therein. I further agree to abide by all Market requirements as outlined above, as well as all federal, State and local laws, codes and regulations, to cooperate with the Market, and to pay all required Vendor fees.
